David practices in the areas of commercial litigation, employment litigation, products liability, motor vehicle litigation and insurance defense. He also has substantial experience in representing coal mining companies in various matters, including mining related liability claims, antitrust actions, and complex contract and royalty disputes. David’s substantial trial experience includes the successful defense of companies and individuals in personal injury and wrongful death jury trials. In addition, he has successfully represented companies in complex trials related to commercial disputes, property damage from road construction and mining activity, and nuisance actions for alleged pollutant contamination to property and streams. David has represented clients in numerous state and federal courts throughout Kentucky and in federal court in Indiana. He has also successfully represented clients in appellate matters before the United States Sixth Circuit Court of Appeals, the Seventh Circuit Court of Appeals, the Kentucky Supreme Court and the Kentucky Court of Appeals. In addition, he has practiced before administrative agencies, including the Equal Employment Opportunity Commission and the Kentucky Commission on Human Rights.
